It is important that you read our T&C carefully to understand your rights and protections, as well as ours. Please contact us at hello@yolkfolk.pl if you have questions regarding these T&Cs.

1. General. Acceptance of Terms

YOLK Spółka z ograniczoną odpowiedzialnością with registered seat in Kraków, ul. Józefa Sarego 5/4, 31-047 Kraków, Poland, entered with the National Court Register into the register of entrepreneurs kept by the District Court for Kraków-Śródmieście in Kraków, 11th Commercial Department of the National Court Register under the number KRS: 818889; Tax Identification Number (NIP): 6762575400, National Business Registry Number (REGON): 385077151, with the share capital of 45,000.00 PLN ("YOLK") provides coworking spaces and other services specified herein.

All contractual relationships between YOLK and any customer of YOLK coworking spaces and services ("Member", together with YOLK the "Parties", each a "Party") shall be governed by these terms and conditions ("T&C"). By registering on the website yolkfolk.pl ("Website"), the Member agrees to be bound by these T&C.

YOLK reserves the right to update the T&C at any time. YOLK will contact you to notify you of any updates within 14 days of their enactment. In case the Member objects to the new T&C they may terminate the Membership Agreement within 14 days of receiving notice of the changes.

Standard business conditions and/or general terms and conditions of the Member do not apply, regardless of whether or not YOLK has expressly objected to them in a particular case.

The YOLK Offices is a commercial facility. Using the Offices or your membership for the purpose of establishing a personal residence is not permitted. The Offices can be used for office work only and in a manner respecting other Members' right to use the Offices.

The Offices are covered by CCTV. The Member by entering into the Membership Agreement consents to the recording, storing and usage of the footage from the CCTV for the purposes connected with the safety of people and property.

YOLK provides a café-style workplace "ClubHouse" at the ground floor of the building, available 24 hours, 7 days a week for members. Members are not residential tenants of the ClubHouse or the Offices.

2. Description of Services

YOLK may provide you with access to the Offices, work stations, the ClubHouse, internet access, office equipment, meeting rooms, and other services (collectively, "Services") depending on the membership plan you choose. All Services are at all times subject to the T&C. Access to any Service will be made available to the Member by an individual code provided by YOLK.

The Member is entitled to rent a locker on a monthly basis upon payment of the applicable fee. YOLK is not liable for any loss or damage to the contents of the Locker. Upon termination, the Member shall return the key. The Member is liable for any damage to the Locker.

It is prohibited to eat food outside of the kitchen area of the Offices and especially in working spaces. The Member acknowledges that each Friday the fridges will be emptied for hygienic reasons.

YOLK is not responsible for management of letters, packages or other deliveries sent to the Member at the space's address, unless the chosen membership plan provides otherwise.

Members are permitted to invite up to two guests into the ClubHouse for a meeting lasting up to two hours, up to four times per month. Guest passes are available at 36 PLN per day for longer visits.

Members using virtual mailbox services are not allowed to register their business at the YOLK address. YOLK is not liable for any content of mail addressed to a Member.

3. Registration. Membership Plans. Membership Agreement. Termination

Any use of YOLK Services requires prior registration on the Website by creating an account and accepting these T&C. The Member must provide accurate and complete information. Each Member will receive a PIN code and smartphone app access upon payment of the membership fee. NFC Cards can be added for a one-off charge of 25 PLN. The Members WiFi password must not be shared with third parties.

The Parties enter into a Membership Agreement when the Member creates an Account, chooses a membership plan, and pays the membership fee for the initial period in advance. The membership fee depends on the membership plan and is stated on the Website. Fees are net prices excluding VAT.

Available Membership Plans

  • Dedicated Membership — Dedicated desk with 24/7 access, ClubHouse access, 8hrs meeting room credit, discounted rates, call booth, free printing & scanning, community access.
  • Flexible Membership — ClubHouse workspace access, 5hrs meeting room access, discounted rates, community access.
  • Community Membership — 5 flexible day passes, discounted meeting room rates, community access.
  • Flexible Day Pass — ClubHouse access for a 24-hour period. First access must be during reception hours Mon–Fri.
  • Flexible Week Pass — ClubHouse access for a seven-day period. First access must be during reception hours Mon–Fri.
  • Dedicated Day Pass — First Floor Workspace access for a 24-hour period.
  • Dedicated Week Pass — First Floor Workspace access for a seven-day period.

This Membership Agreement is automatically renewed at the end of each period until terminated by one of the Parties. Failure to follow the T&C can result in non-renewal or early termination without notice.

The Parties may terminate this agreement for any reason by giving written notice to admin@yolkfolk.pl. The termination period is: 14 days for members using up to 4 desks; 90 days for members using 5 or more desks.

It is prohibited to bring or store any illegal, hazardous or dangerous items in the Offices or the ClubHouse.

4. Terms of Payment

Payment is accepted by online bank transfer, PayPal, and credit card. The Member is automatically charged monthly in advance. In the event of late payment, YOLK reserves the right to charge statutory interest at 5% if payment exceeds 10 working days after the due date.

Early termination of a membership plan will not give rise to any reimbursement of fees previously paid, except in cases of gross negligence or wilful misconduct by YOLK. YOLK shall issue an invoice for any payment made or 5 working days before an invoice is due. The Member consents to receive electronic invoices.

5. No Unlawful or Prohibited Use

As a condition of your use of the Services, you will not use them for any purpose that is unlawful or prohibited by these T&C. You may not use the Services in any manner that could damage, disable, overburden, or impair any YOLK server or interfere with any other party's use of the Services. You may not attempt to gain unauthorised access to any Services, accounts, or computer systems connected to YOLK.

6. Use of Services

You agree that when using the Services, you will not:

  • Use the Services in connection with spam, chain letters, or any unsolicited messages;
  • Defame, abuse, harass, stalk, threaten or otherwise violate the legal rights of others;
  • Publish or distribute any inappropriate, defamatory, obscene, or unlawful content;
  • Upload files containing viruses, Trojan horses, worms, or other harmful software;
  • Infringe any copyright, trademark, patent, or other proprietary right of any party;
  • Harvest or collect information about others without their consent;
  • Violate any applicable laws or regulations; or
  • Create a false identity for the purpose of misleading others.

7. Personal Data

YOLK processes personal data including name, address, email, phone number, and tax identification number in accordance with GDPR and applicable Polish data protection law. YOLK is the Controller of your personal data. Contact: admin@yolkfolk.pl.

Personal data is processed for the purposes of performing the Membership Agreement, sending newsletters, marketing purposes, and meeting legal obligations. Data is retained for the duration of the Membership Agreement and any legally required period thereafter.

You have the right to: access your data, request rectification or deletion, object to processing, restrict processing, data portability, and to lodge a complaint with the Polish supervisory authority (Prezes Urzędu Ochrony Danych Osobowych).

You grant YOLK permission to take photographs or film your person in the Offices and the ClubHouse for promotional and commercial use, without remuneration. Pre-warning will be given to allow for any objections.

8. Confidentiality

During your use of the Services you may be exposed to confidential information belonging to YOLK or other Members. You agree to: maintain all Confidential Information in strict confidence; not disclose it to third parties; and not use it in any way detrimental to YOLK or other Members. All Confidential Information remains the sole and exclusive property of YOLK or the respective disclosing party.

9. Participation In or Use of Services

You acknowledge that you are participating in or using the Services at your own free will and decision. YOLK does not have any liability with respect to your access, participation in, or use of the Services, or any loss of information resulting from such participation or use.

10. Indemnification & Limited Liability

Members understand that if someone or something at the Offices or at the ClubHouse is hurt or damaged as a result of the Member's own negligence, the Member is responsible for that injury or damage.

In no event shall YOLK or its employees, shareholders, representatives or guests be liable for any direct, special, incidental, indirect, punitive, consequential or other damages arising out of or in any way related to the participation in or inability to participate in the Services.

Members agree not to hold YOLK or its employees liable for the loss, theft, or damage of personal belongings including laptops, phones, bags, wallets, or similar items.

11. Severability

In the event that any provision of these T&C is determined to be invalid, illegal or unenforceable, the remaining provisions shall remain in full force and effect to the fullest extent permitted by applicable law.

12. Miscellaneous

These T&C and the Membership Agreement shall be governed by the laws of the Republic of Poland. Both Parties submit to the exclusive jurisdiction of the common courts of Kraków, Poland.

13. YolkOS Mobile Application

This section is an addendum to the main T&C and governs your use of the YolkOS mobile application ("App"). In the event of conflict between this section and the main T&C, this section prevails in respect of App-specific matters.

13.1 App Access & Membership Dependency

Access to the App is available exclusively to current Yolk members with an active membership plan. Your App account is linked to your membership status.

App access is automatically suspended when your membership lapses, is terminated, or is placed on hold. Reactivating your membership restores App access. YOLK reserves the right to suspend App access independently if a member breaches these T&Cs or this addendum, without terminating the underlying membership.

13.2 Account & Authentication

The App uses one-time passcode (OTP) authentication sent to your registered email address. You are responsible for keeping your email account secure. Each login session remains active for up to 30 days, after which re-authentication is required.

You must not share your App access with third parties. Each account is personal and non-transferable.

13.3 User-Generated Content

The App allows members to create content including profile information (name, photo, one-liner, interests), messages in the community chat channel, direct messages to other members, and posts or responses on the community feed.

You retain ownership of content you create. By submitting content, you grant YOLK a non-exclusive, royalty-free licence to store, display, and transmit that content solely for the purpose of operating the App and providing the Services to other members.

You are solely responsible for content you post. You agree not to post content that:

  • is unlawful, defamatory, harassing, threatening, or discriminatory;
  • infringes the intellectual property rights of any third party;
  • contains spam, unsolicited commercial messages, or promotional content;
  • impersonates another person or entity;
  • discloses another member's personal information without their consent; or
  • violates any applicable Polish or EU law.

YOLK reserves the right to remove any content that violates these rules, and to suspend or terminate App access for repeated or serious violations, without prior notice.

13.4 Chat & Direct Messages

The App includes a community chat channel (#general) and direct messaging between members. These features are designed to facilitate genuine professional and social connection within the Yolk community.

Community chat messages are retained for 30 days and then automatically deleted. Direct messages are stored for the duration of your membership and deleted within 90 days of membership termination.

YOLK does not routinely monitor private direct messages. However, YOLK may access message content if required to investigate a reported violation of these T&Cs, respond to a legal obligation, or protect the safety of members or third parties.

Practical note for members: the App's chat is ambient and low-pressure — it is not a substitute for Slack or email. If you receive an unwanted message from another member, use the in-app report function or contact hello@yolkfolk.pl.

13.5 Random Coffee Opt-In

The Random Coffee feature pairs opted-in members weekly for an informal coffee meeting at the Yolk Welcome Hub. Participation is entirely voluntary.

By opting into Random Coffee, you consent to your first name, profile photo, company or role, and any skills or interests you have listed being shared with your matched member for that week. You may opt out at any time in your App profile settings. Opting out takes effect from the following Monday pairing cycle.

13.6 Member Directory & Profile Visibility

The member directory displays profiles of active members who have completed onboarding. You control your directory visibility via the privacy settings in your App profile:

  • Directory visible (default on): your profile appears in the member directory to other active members.
  • Directory hidden: your name and profile are not shown in the directory. You will still appear in the Who's In view to members who are checked in on the same day.
  • Open to Chat status: a voluntary daily toggle indicating you welcome informal conversation. This resets automatically at midnight. It is visible to checked-in members on the Unlock screen.

Profile information you enter (bio, one-liner, interests, skills) is visible to other active Yolk members only. It is not publicly indexed or shared outside the App.

13.7 Door Unlock & Access Logging

The App's primary function is unlocking Yolk's access-controlled doors via the UniFi Access system. Each door unlock event — including the door unlocked, timestamp, and member identity — is logged for security and access management purposes.

This logging is necessary for the performance of the Membership Agreement (your right to physical access) and for YOLK's legitimate security interests. You cannot opt out of unlock logging while remaining an active member.

Unlock logs are retained for 12 months and then deleted, unless a specific incident requires retention for a longer period.

13.8 App Analytics & Usage Data

If you provided analytics consent during onboarding, the App collects anonymised usage data to help YOLK improve the product and understand community health. This may include:

  • screens visited and features used;
  • App open frequency and session length;
  • Random Coffee match and completion data (aggregated);
  • push notification open rates.

No analytics data is sold to third parties or used for advertising. You may withdraw analytics consent at any time in your App profile settings. Withdrawal does not affect data already collected.

13.9 Push Notifications

By installing the App, you may receive push notifications relating to: new direct messages, Random Coffee matches and reminders, community events, and important service updates.

You can manage notification preferences within the App (Profile → Notifications) or through your device's system notification settings. Disabling notifications will not affect your App access, but may mean you miss time-sensitive community updates.

13.10 Third-Party Services

The App integrates with the following third-party services to deliver its functionality:

  • Supabase (Ireland) — database, authentication, and real-time messaging infrastructure;
  • OfficeRnD (UK/EU) — membership status verification and room booking;
  • UniFi Access (Ubiquiti, USA) — door control via local network;
  • Brevo (France) — OTP email delivery;
  • Expo / Apple / Google — app distribution and push notification delivery.

Data transfers to services outside the EEA are governed by Standard Contractual Clauses or equivalent transfer mechanisms. Details are available on request at hello@yolkfolk.pl.

13.11 App Updates & Changes

YOLK may update the App at any time to fix bugs, add features, or modify existing functionality. Over-the-air updates (changes to app logic that do not require an App Store download) may be applied automatically.

Material changes to these T&Cs that affect your rights will be communicated via push notification or email with at least 14 days' notice, consistent with Section 1 of the main T&Cs.

13.12 Limitation of Liability — App

YOLK provides the App on an 'as available' basis. We do not guarantee uninterrupted availability. The App depends on third-party infrastructure (Supabase, UniFi, Cloudflare) and local network connectivity at Yolk Sarego.

YOLK is not liable for: failure to unlock a door due to network interruption (please use the physical keypad as backup); loss of chat messages due to the 30-day expiry; or data loss caused by third-party infrastructure failure.

These limitations apply to the fullest extent permitted by applicable Polish law and do not affect your statutory consumer rights.
